Rubbish TakeOut Terms and Conditions of Service

This agreement (the "Agreement") is entered into between you (the "Customer") and Rubbish TakeOut LLC (referred to as "Rubbish TakeOut," "we," "our," or "us"). By using our services, you acknowledge that you have read, understood, and agreed to these terms. If you do not agree, you may not use our services.

1. Definitions

  • “Rubbish TakeOut” refers to Rubbish TakeOut LLC, providing waste bin management services.

  • “Bin Dashers” refers to Rubbish TakeOut employees or contractors who perform can-to-curb services.

  • “Chute Runners” refers to Rubbish TakeOut employees or contractors who provide valet trash services.

2. Service Description

Rubbish TakeOut offers two primary services:

  1. Can-to-Curb Service: Retrieving trash and recycling bins from the Customer’s storage location, placing them at the curb according to city regulations or customer preferences, and returning them after collection.

  2. Valet Trash Service: Collecting trash and recycling from apartment or community doorsteps and delivering it to the designated disposal area.

Services are provided according to the schedule agreed upon during registration.

3. Home and Property Access

By subscribing to Rubbish TakeOut services, you grant our Bin Dashers and Chute Runners permission to access your property as needed to provide services.

  • Customers are responsible for ensuring clear and safe access to bins, including providing gate codes, lock combinations, or other access information if necessary.

  • If our team cannot access your bins due to locked gates, blocked paths, unrestrained pets, or other obstructions, service will not be completed, and no refunds or credits will be provided.

  • For properties with garage access, customers must provide a functioning access code and maintain a hazard-free garage. Rubbish TakeOut is not responsible for disarming or resetting security systems.

4. Customer Responsibilities

  • Ensure bins are accessible by the earliest time allowed by your city or your requested service window.

  • Keep pets restrained and away from service areas.

  • Maintain bins in sanitary condition; excessively dirty or smelly bins may not be serviced.

  • Avoid overloading bins and ensure lids are fully closed.

  • Clear any trash or obstacles that may block access to bins.

5. Service Phases and Billing

Rubbish TakeOut offers the most competitive pricing in the nation through a phased approach designed to meet your needs:

  • Phase 1: First Month Free: New customers receive their first month of service at no cost.

  • Phase 2: Route Starter Phase: For the next three months, customers benefit from introductory pricing designed to help establish regular service.

  • Phase 3: Standard Phase: After the Route Starter Phase, customers transition to our standard pricing, ensuring continued affordable service.

Customers will receive an invoice at the start of each month. Payments are due within 7 days of the invoice date.

  • Auto-pay is available and optional. Customers may enroll after the first month.

  • Applicable sales tax will be added to the monthly invoice.

  • Late payments may result in a late fee.

6. Price Changes

Rubbish TakeOut reserves the right to adjust pricing with 60 days’ written notice. If the Customer does not agree to the new pricing, they may cancel the service with no penalty.

7. Service Interruptions

  • Holidays: Services will be adjusted if trash collection is delayed.

  • Inclement Weather: For safety reasons, services may be delayed, rescheduled, or canceled due to severe weather conditions.

  • Road Closures: If our team cannot access your property due to road closures, service will be canceled for that day without refund.

  • Software or Telecommunication Issues: We are not responsible for service interruptions caused by system malfunctions or third-party applications.

8. Cancellation Policy

  • Customers may cancel service at any time with 30 days’ written notice.

  • Cancellation requests should be submitted via email to info@rubbishtakeout.com or through the customer account page on our website.

  • No refunds or credits will be issued for unused portions of a billing period.

For commercial accounts or properties with volume pricing, a minimum 60-day notice is required.

9. Liability and Disclaimer

  • Rubbish TakeOut is not responsible for damage to bins or property unless caused by gross negligence.

  • We are not liable for damage caused by weather, vandalism, misuse, or acts of nature.

  • Rubbish TakeOut is not responsible for damage caused by vehicles hitting or backing into bins.

  • Customers are responsible for ensuring their property meets all safety and code compliance requirements.

10. Right to Refuse Service

Rubbish TakeOut reserves the right to refuse service to any property if conditions are unsafe, access is obstructed, or the Customer fails to comply with these Terms and Conditions.

11. Electronic Communications and Notifications

  • By using our service, you agree to receive communications via email, text message, or phone regarding service updates, billing, and notifications.

  • Customers can opt out of promotional messages by following the instructions provided in the message.

12. Dispute Resolution and Arbitration

  • Any disputes arising from this Agreement shall be governed by the laws of the State of California.

  • Disputes shall be resolved through binding arbitration in Los Angeles, CA.

  • Both parties waive the right to a trial by jury.

13. Force Majeure

Rubbish TakeOut shall not be liable for delays or failures in performance due to events beyond its reasonable control, including acts of God, natural disasters, labor strikes, government actions, and pandemics.

14. Customer Satisfaction

Our goal is to provide reliable and convenient service. If a service is not completed to your satisfaction, please notify us within 7 days by emailing info@rubbishtakeout.com.

15. Changes to Terms and Conditions

Rubbish TakeOut reserves the right to update these Terms and Conditions at any time. The updated terms will be posted on our website, and continued use of the service constitutes acceptance of the revised terms.
